By installing, accessing, or utilizing the Services in any capacity, you expressly consent to our collection, processing, and use of your Personal Information as outlined in this document. If you disagree with any provision set forth herein, your sole and exclusive remedy is to discontinue use of the Services.

1. Information We Collect and Receive

We operate on the principle of data minimization, collecting only the absolute minimum amount of data required to provide a functional, secure, and competitive gaming environment.

1.1 Information You Actively Provide

• Account Identity Data: When establishing a Neon Swarm profile, whether through direct registration or third-party Single Sign-On (SSO) providers like Google OAuth, we collect your Email Address. This information is strictly used as an administrative credential to secure your account across devices.
• Public Profile Data: You will be prompted to create a Username. This Username is intrinsically public and will be displayed on the global competitive leaderboards. We strongly advise against using your real name or any personally identifiable information as your Username.
• Customer Support Correspondence: If you contact us for technical support, bug reports, or feature requests, we will collect your email address and the contents of your message solely for the purpose of resolving your inquiry.

1.2 Information Collected Automatically

• Telemetry and Gameplay Metrics: As you interact with the game, we automatically record performance metrics including, but not limited to: high scores, game session durations, levels attained, and specific in-game achievements. This data is the foundation of the Services' global leaderboard functionality.
• Device and Technical Information: We automatically collect specific technical information from your device. This may include your IP address, device type, mobile operating system version, browser type, screen resolution, and unique device identifiers (such as Android Advertising ID or Google Play Services ID). This data assists us in diagnosing technical anomalies and optimizing the software for varying hardware profiles.
• Log Files and Diagnostics: Like most online services, our servers automatically record certain information in server logs. This may include web requests, timestamp data, and referring/exit pages. This information is crucial for maintaining the security of our infrastructure against malicious actors and Distributed Denial of Service (DDoS) attacks.

2. Legal Basis for Processing (GDPR Compliance)

If you are an individual located in the European Economic Area (EEA) or the United Kingdom, we collect and process information about you only where we have a legal basis for doing so under applicable EU laws. Our legal bases include:

• Contractual Necessity: We process your Email Address and Gameplay Data because it is strictly necessary to perform our contract with you—specifically, providing you access to the cloud-saved game state and the global leaderboard features.
• Legitimate Interests: We process diagnostic and device information to further our legitimate interests in securing our application, preventing fraud, and analyzing game crashes to improve user experience.
• Consent: Where required by law, we will obtain your explicit consent prior to processing your data. You may withdraw this consent at any time.

3. How We Utilize Your Information

Your Personal Information is never sold, traded, or used for targeted behavioral advertising. We use the collected data exclusively for the following operational purposes:

• To provision, maintain, and secure your account access across multiple platform environments.
• To validate score submissions and prevent tampering, cheating, or leaderboard manipulation.
• To publicly broadcast your chosen Username alongside your highest recorded game scores.
• To perform internal quality assurance, bug tracking, and stability enhancements.
• To respond to your customer service inquiries and support requests.
• To enforce our Terms of Service and comply with applicable legal obligations.

4. Data Sharing and Third-Party Disclosures

We are not data brokers. We share your information exclusively with trusted third-party service providers who assist us in operating our Services. These entities are contractually obligated to maintain strict confidentiality and are prohibited from using your data for any independent purposes.

• Infrastructure Providers: We utilize third-party cloud hosting architectures (e.g., MongoDB Atlas, Vercel, Netlify) to house our databases and API endpoints.
• Authentication Providers: If you utilize Google Login, we exchange standard cryptographic OAuth tokens with Google's identity servers to verify your credentials. You can manage these permissions directly through your Google Account Security Dashboard.
• Legal & Regulatory Authorities: We reserve the right to disclose your Personal Information as required by law, such as to comply with a subpoena, court order, or similar legal process, or when we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.

5. International Data Transfers

Neon Swarm operates globally. Your Personal Information may be transferred to, and maintained on, servers or databases located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. By using the Services, you consent to the transfer of your data to the United States and other regions where our infrastructure providers operate, safeguarded by Standard Contractual Clauses (SCCs) where applicable.

6. Security and Encryption Practices

We employ a robust, multi-layered approach to data security:

• Transport Layer Security (TLS/HTTPS): All communications between the Neon Swarm client application and our backend REST APIs are encrypted in transit.
• At-Rest Encryption: Data stored within our primary database environments is encrypted at rest using AES-256 encryption standards.
• Cryptographic Hashing: For users who create manual accounts, we salt and hash passwords using bcrypt algorithms. We do not possess the ability to read or decrypt your password.

However, no method of transmission over the Internet or method of electronic storage is mathematically impenetrable. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

7. Data Retention Policies

We adhere to strict data retention minimizing principles. We will retain your Personal Information only for as long as your account remains active and in good standing. If an account remains completely dormant (no logins or gameplay activity) for a continuous period of 36 months, we reserve the right to automatically purge the account and permanently anonymize or delete all associated high scores and identifiers. You may also actively request deletion prior to this automated period.

8. Your Comprehensive Privacy Rights

We believe that privacy rights should be universal, regardless of your geographic location. As such, we offer the following rights to all users:

• Right of Access & Portability: You may request a complete export of the personal data we hold about you in a structured, machine-readable format.
• Right to Rectification: You may request corrections to any inaccurate or incomplete personal data.
• Right to Erasure (The Right to be Forgotten): You have the absolute right to demand the immediate and permanent deletion of your account, email address, and leaderboard entries from our active databases.
• Right to Restriction of Processing: You may request a temporary halt to the processing of your data under specific legal conditions.

To exercise any of these rights, please submit a written request to the developer contact email listed below. We pledge to respond to all verifiable requests within thirty (30) days.

9. California Privacy Rights (CCPA & CalOPPA)

If you are a resident of California, the California Consumer Privacy Act (CCPA) provides you with additional rights regarding your personal information. We explicitly state that we do not sell your personal information. California residents may request information regarding the disclosure of their personal information to third parties for those third parties' direct marketing purposes under California's "Shine the Light" law. Furthermore, our Services currently do not respond to "Do Not Track" (DNT) signals from web browsers.

10. Nevada Privacy Rights

Under Nevada law, certain Nevada consumers may opt out of the sale of "personally identifiable information" for monetary consideration. As stated previously, Neon Swarm does not engage in such sales. However, if you are a Nevada resident, you may submit a request to opt-out of any potential future sales under Nevada law by contacting us.

11. Children's Privacy and COPPA

Our Services are not directed to children under the age of 13. We do not knowingly collect, maintain, or utilize personally identifiable information from children under 13 years of age. If you become aware that your child has provided us with Personal Information without your consent, please contact us immediately. Upon verification, we will take immediate steps to remove such information and terminate the child's account in compliance with the Children's Online Privacy Protection Act (COPPA).

Our Services may contain links to external sites that are not operated by us. If you click on a third-party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit. We assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

We reserve the unilateral right to update, amend, or modify this Privacy Policy at any time to reflect changes in legal, regulatory, or operational requirements.
